PURCHASING IN SPAIN
Buying a property in Spain is probably the biggest single investment that you will ever make. For many the process seems straightforward but it is very different from the UK.
It is advisable to seek independent legal advice when you are considering purchasing in Spain.
Buyers are not always advised about the appropriate checks and searches that should be carried out to ensure the property is purchased free of encumbrances, charges, debts and local taxes.
Spanish property transactions attract various fees and taxes for both buyers and sellers. The Purchase Contract should stipulate who is responsible for what.
The Escritura (title deed) price needs to be agreed at an early stage. The document will be in Spanish and you need to make sure you understand exactly what you are buying.
SPANISH WILLS & INHERITANCE TAX
Inheritance Tax is a huge concern for those who own property in Spain.
If you are not an official tax resident in Spain then your Spanish assets will almost certainly be subject to Spanish Inheritance Tax.
Making a Spanish Will avoids time consuming and expensive legal problems for your heirs.
English Nationals are not obliged to follow the Spanish Law of compulsory heirs.
UTILITY & SUMA CHANGES
Utility Contracts & Suma bills must be changed into the name of the new property owner. Essential services, such as electric and water need to be set up to be paid by direct debit/standing orders by which the companies will require payment of their bills.
NIE & RESIDENCIAS
All foreigners with any kind of fiscal (tax) obligations here in Spain are required to obtain a foreigner's identity number, called an NIE (Número de Identificación de Extranjero), which identifies you to the Spanish tax authorities.
This original NIE Certificate is essential when completing various transactions including buying and selling property, registering a vehicle, Annual Tax declarations.
